Corporations, technology, and the law – future of the firm

Presented by ANU College of Law, Governance & Policy

Technology is changing the way companies function. Akshaya’s forthcoming book, Corporations, Technology, and the Law, attempts to chart the changes, possible legal responses, and way forward.

Corporations are actors both in markets and in society. Technology complicating (sometimes in good ways and sometimes in bad ways) the operations of the corporate form, therefore, has wide-reaching implications.

Akshaya’s forthcoming book, Corporations, Technology, and the Law (Oxford University Press, 2026) examines how corporations are changing as a result of various new and not so new technologies, and the corresponding legal and governance challenges involved.

The broad argument of her book is two-fold: first, the corporate form with humans at the helm has to be preserved because there is an element of humanity that is required at the apex of the corporation, which is the board of directors; and second, while law has a useful role to play in mediating this period of tech-upheaval in the corporate form, purely top-down legislation will not be the answer because much of the knowledge regarding the new technology and its deployment is with the companies rather than the regulators.
